1. ACCEPTANCE OF TERMS
These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User,” “you,” or “your”) and MC Software, LLC, a Delaware limited liability company (“MC Software,” “we,” “us,” or “our”), governing your access to and use of the Pixel Pirates AI website, applications, platform, APIs, tools, and related services (collectively, “Pixel Pirates” or the “Service”). By accessing or using the Service, you expressly acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not access or use the Service. You represent that you are at least eighteen (18) years old and have the legal capacity to enter into this agreement.

2. CHANGES TO TERMS
We reserve the right to modify, amend, or replace these Terms at any time, in our sole discretion. Any changes become effective immediately upon posting. Continued use of the Service constitutes acceptance of the revised Terms.

3. DESCRIPTION OF THE SERVICE
Pixel Pirates provides artificial intelligence–powered tools for generating images, videos, and related content using machine learning models. THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE MAKE NO GUARANTEES REGARDING ACCURACY, QUALITY, RELIABILITY, LEGALITY, OR FITNESS FOR ANY PARTICULAR PURPOSE. We may modify, suspend, restrict, or discontinue the Service at any time without liability.

4. EXPERIMENTAL TECHNOLOGY ACKNOWLEDGMENT
You acknowledge that the Service uses experimental, evolving, and probabilistic artificial intelligence technologies. Outputs maybe inaccurate, misleading, offensive, incomplete, or unpredictable. You assume all risks associated with the use of experimental AI systems.

5. NO RELIANCE; NO PROFESSIONAL ADVICE
Outputs are generated automatically and without human review. Outputs do not constitute legal, medical, financial, business, or professional advice. You agree not to rely on Outputs without independent verification. MC SOFTWARE DISCLAIMS ANY DUTY OF CARE REGARDING OUTPUTS.

6. USER CONTENT AND AI TRAINING
You retain ownership of content you submit (“Inputs”), subject to the licenses granted herein. You grant MC Software a worldwide, perpetual, irrevocable, royalty-free, sub-licensable license to use, host, store, reproduce, modify, analyze, and process Inputs to operate, maintain, improve, and train AI systems. Inputs may be used to train or improve artificial intelligence models unless explicitly stated otherwise by MC Software in writing. Outputs may not be unique and may resemble content generated for other users. MC Software makes no representations regarding ownership or non-infringement of Outputs.

7. PROHIBITED USES
You may not use the Service to violate laws, infringe rights, generate unlawful or harmful content, reverse engineer the Service, or interfere with safeguards.

8. FEES ANDNO REFUNDS
All fees are non-refundable except as required by law. App store purchases (e.g., in Apple Store, Google Play, etc.) are governed by their respective refund policies.

9. TERMINATION
We may suspend or terminate access at any time, with or without notice. All provisions that by their nature should survive termination shall survive.

10. DISCLAIMER OF WARRANTIES
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MC SOFTWARE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED.

11. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MC SOFTWARE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF $100 OR AMOUNTS PAID BY YOU TO MC SOFTWARE IN THE PRIOR TWELVE (12) MONTHS.

12. INDEMNIFICATION
You agree to fully defend, indemnify, and hold harmless MCSoftware from all claims arising from your use of the Service, Inputs, Outputs, or violation of these Terms.

13. ARBITRATION AND CLASS ACTION WAIVER
All disputes shall be resolved by binding arbitration in the State of Delaware. Class actions and representative proceedings are waived.

14. GOVERNING LAW
These Terms are governed by the laws of the State of Delaware.

15. SEVERABILITY
If any provision is unenforceable, the remaining provisions remain in effect.

16. ENTIRE AGREEMENT
These Terms (along with the accompanying Privacy Policy, Security Statement, Acceptable Us Policy, DMCA Policy, and AI Transparency Risk Disclosure as posted on this website) constitute the entire agreement between you and MC Software regarding the Service.
